Article 1: Object

The Provider offers website creation, graphic design, and web maintenance services. The offers are divided into two main models:

• "Purchase" Service (Showcase / Signature Site): Cash or installment payment for the creation of a site of which the Client becomes the owner.
• "Rental" Service (Serenity Pack): Monthly subscription including the provision of a site, hosting, and maintenance.

Article 2: Orders and Quotes

Any order is firm and final upon signature of a quote or validation of an online order, accompanied by the payment of the stipulated deposit (generally 30% to 50% or setup fees for rental).

Article 3: Pricing and Payment

3.1. Flat-rate Services (Purchase)

Payment is made according to the schedule defined in the quote (e.g., 50% upon order, 50% upon delivery). In the event of late payment, late penalties may be applied.

3.2. Subscription Services (Rental)

The "Serenity Pack" implies a monthly payment by direct debit. Any payment incident may result in the immediate suspension of services (site offline) after an unsuccessful reminder.

Article 4: Duration and Termination (Rental Offers)

For subscription offers (Serenity Pack), the contract is concluded for a minimum commitment period of 12 months.

At the end of this period, the contract is renewable by tacit agreement (automatic renewal) for successive periods of 1 month. The Client may terminate their subscription at any time after the commitment period, with 30 days' notice, by registered letter or email with acknowledgment of receipt.

In the event of termination, the website will be taken offline. The Client may recover their raw data (texts and images) upon simple request, but may not keep the source code of the specific technical architecture provided as part of the rental, unless a buyout agreement is reached.

Article 5: Intellectual Property

5.1. Website (Purchase Offer)

The Provider assigns the exploitation rights of the delivered website (HTML/CSS/JS files) to the Client once full payment has been made. The Client is free to host the site wherever they wish.

5.2. Graphic Creations and Branding

Unless otherwise stated ("Rights Transfer" Option or "Signature Pack"), the Provider retains moral ownership and working source files of graphic creations (logos, mockups). The Client has an extended right of use for their activity.

For the "Signature Pack", the transfer of economic rights (for IP filing/trademark deposit) is included.

Article 6: Obligations and Liability

The Client undertakes to provide the content (texts, images) necessary for the creation of the site within the agreed deadlines. The Provider cannot be held responsible for delivery delays due to a lack of client content.

The Provider undertakes to implement all technical means to ensure the proper functioning of the site (obligation of means). Their liability cannot be engaged in the event of malfunction of the third-party host, hacking, or modification of the site by the Client.

Article 7: Warranty

The Provider offers a 3-month operating warranty after delivery. During this period, any technical bug originating from the delivered code will be corrected free of charge. This warranty does not cover problems related to mishandling by the Client or updates to third-party browsers/hosts.
